Welcome to Agave. These Terms of Service ("Terms") govern your access to and use of the website located at agave-products.com (the "Site"), and any purchase you make through it. By accessing the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
Agave products are also available through TikTok Shop. Purchases made there are governed by TikTok Shop's own terms and checkout process; these Terms apply to purchases made directly on our Site.
1. Who We Are
Agave is operated by Agave Products, LLC, a Washington limited liability company ("Agave," "we," "us," or "our"). You can reach us at hello@agaveproducts.com.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order on the Site. By using the Site, you represent that you meet this requirement.
3. Products
We design and sell outdoor and lifestyle soft goods, including the Agave Pack, the ARROYO, and related accessories. We make reasonable efforts to display product colors, materials, and dimensions accurately, but we do not guarantee that your device's display will match the product exactly. Product availability, configurations, and specifications are subject to change without notice.
4. Pricing and Payment
- All prices are listed in USD and do not include applicable taxes or shipping, which are calculated at checkout.
- We reserve the right to change prices at any time before an order is placed. Once an order is confirmed, the price at time of purchase applies.
- Payment is processed at the time of order through our third-party payment processor. By submitting payment information, you represent that you are authorized to use the payment method provided.
- We reserve the right to refuse or cancel any order, including in cases of suspected fraud, pricing errors, or inventory issues. If we cancel an order after payment has been collected, you will receive a full refund.
5. Shipping
We currently ship to addresses within the United States and Canada. Shipping timelines and costs are provided at checkout and are estimates only; we are not responsible for carrier delays. Risk of loss and title for products pass to you upon our delivery to the shipping carrier.
International customers (outside the US and Canada) are responsible for any customs duties, import taxes, or fees assessed by their country; we do not collect or estimate these at checkout.
6. Returns and Exchanges
We want you to love what you order. If you're not satisfied:
- You may return or exchange unworn, unused items with original tags attached within 30 days of delivery.
- To start a return, contact us at hello@agaveproducts.com with your order number.
- Return shipping costs are the responsibility of the customer unless the item arrived damaged or defective, or we made an error with your order.
- Refunds are issued to the original payment method once the returned item is received and inspected. Please allow 5–10 business days for processing.
- Sale items and gift cards are final sale, unless otherwise noted at time of purchase.
7. Product Warranty
We stand behind the craftsmanship of our products. If a product fails due to a defect in materials or workmanship under normal use within 1 year of purchase, contact us at hello@agaveproducts.com and we will repair or replace it at our discretion.
8. Intellectual Property
All content on the Site — including the Agave name, logo, product designs, photography, and written content — is owned by or licensed to Agave and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our prior written permission.
9. User Conduct
When using the Site, you agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms
- Attempt to gain unauthorized access to the Site, other accounts, or our systems
- Interfere with the Site's operation or security
- Submit false or misleading information, including fraudulent payment information
We reserve the right to suspend or terminate access to the Site for anyone who violates these Terms.
10. Third-Party Links and Services
The Site may link to or integrate with third-party services (such as our payment processor or shipping carriers). We are not responsible for the content, policies, or practices of third-party sites or services.
11. Disclaimer of Warranties
The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, error-free, or secure.
12. Limitation of Liability
To the fullest extent permitted by law, Agave and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or products purchased through it. Our total liability for any claim relating to your order will not exceed the amount you paid for the product(s) at issue.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
13. Indemnification
You agree to indemnify and hold Agave harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Site.
14. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles. Any disputes arising from these Terms or your use of the Site will be resolved in the state or federal courts located in Washington, unless otherwise required by applicable consumer protection law in your jurisdiction.
